If you are below 18 years old, please obtain the consent of your parent or legal guardian before joining us in any activity.

WAIVER AND RELEASE OF LIABILITY

You hereby acknowledge and agree that you have of your own volition and at your own risk chosen to participate in the classes, practice sessions, performances and/or use equipment provided by Studio Starfire (“Studio Starfire Activities”). You further understand, acknowledge and agree freely and voluntarily that due to the nature of pole fitness and Studio Starfire Activities, the activities you would engage in, including executing pole tricks and participating in exotic pole and chair dance, come with inherent risks and dangers that may cause injury, be it physical, bodily or otherwise, if not executed properly or as instructed. Before enrolling with Studio Starfire and joining us in any activity, you should where necessary seek the advice of a physician. As Studio Starfire is a pole fitness studio and not a medical organisation, Studio Starfire and/or our studio instructors cannot give you medical advice or diagnosis. Studio Starfire reserves the right to terminate your enrolment if we discover any undisclosed health conditions which would, or would likely, affect your ability to participate in any Studio Starfire Activities; in the event that the relevant Studio Starfire Activities have commenced, we may at our sole discretion provide a full or partial refund for any fees paid.

You understand and agree that it is your responsibility to select the appropriate level of courses available at Studio Starfire based on your skills and abilities, to judge your physical and mental capabilities at all times while engaging in Studio Starfire Activities, and to ensure that you will not exceed your limits while engaging in Studio Starfire Activities. You understand that, from time to time, Studio Starfire and/or our studio instructors may suggest physical adjustments, or the use of equipment but it is ultimately your responsibility to determine if any such suggested adjustment or equipment is appropriate for your level of ability, physical and mental condition. You acknowledge that it may not be possible for our studio instructors to provide supervision, safety instructions and recommendations to you at all times, in particular for group classes. You also understand that use of equipment available at Studio Starfire premises constitutes an acceptance of said equipment on an “AS IS” basis. You are at liberty to cease or suspend participation at any time if you make the judgment that you are unable to continue or execute any action, or if you feel that any action may pose danger or cause injury to yourself.

Studio Starfire is not responsible for (i) any sudden and unforeseen malfunctioning of any equipment provided; (ii) any injury sustained by slipping and/or falling while in Studio Starfire premises, including areas outside the Studio premises such as adjacent sidewalks, staircases and parking areas; and (iii) any personal belongings and property that is lost, stolen, or damaged while in, on, or about Studio Starfire premises.

You expressly waive and release any claim that you may have at any time for injury of any kind against Studio Starfire, its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates, and representatives. You hereby expressly agree to indemnify, defend and hold harmless Studio Starfire from and against any and all claims, lawsuits, actions, liability, damages, loss, costs or expense, including legal fees incurred as a result of injuries sustained, death, personal injury or damage to property caused by, arising out of or incidental to Studio Starfire Activities. In addition, you hereby voluntarily hold harmless Studio Starfire from any and all claims that may be brought by my family, state, heirs or assigns.

You agree that this Waiver and Release of Liability is effective for as long as you engage in Studio Starfire Activities and throughout the duration of your relationship with Studio Starfire.

Studio Starfire reserves the right to turn away or exclude any individual from the premises and any of our platforms without cause, reason or notice and with immediate effect in the event of any conduct or behavior-related concerns which may cause nuisance or be injurious to the character or interests of Studio Starfire, students or staff, or if Studio Starfire is of the opinion that the individual concerned is not suitable for continued patronage of Studio Starfire. CLASS STRUCTURE

All classes require a minimum number of students to start. If there are insufficient sign-ups for a class, Studio Starfire reserves the right to make all necessary adjustments, including cancelling, rescheduling or combining classes as required; students will be notified in such instances. Students are welcome to utilize the options that Studio Starfire has made available to make-up any lessons they may miss in advance, including a Facebook page for assisting with direct make-up class swaps between students, tagging of Instructors for assistance, as well as manual Studio assistance with individualized make-up requests. Due to limited manpower, complimentary manual Studio assistance will be rendered a maximum of two times per student per class per term.
